We kindly ask users to carefully read these Terms and Conditions as they include the Terms of Use of the website, General Contracting Conditions, and, where applicable, Specific Conditions regarding certain services. Users are informed that, in the event of any discrepancy, the specific conditions shall prevail.

It is important for our users to be aware of these terms and conditions as they regulate the rules for using the website and online store, as well as the commercial relationships that may arise with our buyers.

Please note that by simply accessing the website, as well as purchasing our products offered through the online store, you will acquire the status of a user. By doing so, Fauna Collect will consider these Terms and Conditions fully accepted.

Fauna reserves the right, at its sole discretion and at any time, to revise these Terms and Conditions in order to modify or introduce provisions resulting from legislative changes or corporate decisions.

All modifications will be communicated to users, who will be deemed to have accepted them when they continue using the website.

Similarly, Fauna reserves the right to modify the structure and design of the website, as well as its services or content and their features. Access to the website may also be suspended during modification, repair, updating, or improvement tasks.

Responsibility of Fauna Collect

Fauna is not responsible for deficiencies in service from its service provider, communication networks, or issues arising from the malfunction or use of outdated versions of any browser. Additionally, Fauna is not liable for prolonged interruptions in power supply, telecommunication failures, social conflicts, strikes, explosions, floods, government acts or omissions, and, in general, any cases of force majeure or unforeseen circumstances.

Both access to the website and the use of the information contained therein are the sole responsibility of the user. Fauna will therefore not be liable for any consequences arising from such access or use of the information. However, it will take steps to remove any harmful content as soon as it becomes aware of it.

Fauna is not liable for potential security errors that may occur or for any damage that may be caused to the user's computer system, files, or stored documents when originating from a virus on the user's computer, browser malfunction, use of outdated versions, telephone failures, interferences, omissions, or disconnections beyond Fauna Collect's control.

User Obligations and Responsibilities

As a general principle, the user is required to comply with all obligations specified in these Terms and Conditions and to always act in accordance with the law, good customs, and good faith. Users must exercise due diligence in the use of services and refrain from using the website in any way that may impair, damage, or deteriorate its normal operation, the property, or the rights of Fauna, other users, or any third party.

Specifically, the user agrees to provide truthful data when required for service provision and to refrain from:

-Introducing, storing, or disseminating any defamatory, offensive, obscene, threatening, xenophobic, violent, or discriminatory content that violates morality, public order, fundamental rights, public freedoms, honor, privacy, or third-party image rights.

-Introducing, storing, or disseminating through the website any software, data, virus, or code that may damage the website, services, equipment, systems, or networks of Fauna or any third party.

-Impersonating third parties when using the website.

-The user shall be liable for any infringement of these obligations and any damage caused.

General Contracting Conditions

These General Contracting Conditions, along with any applicable specific conditions, expressly regulate the commercial relationships between Fauna and users who purchase products through the online store.

Fauna may unilaterally modify, at any time, any of the provisions contained in this text, whether by deleting, limiting, or temporarily or permanently suspending them.

These conditions have been drafted in accordance with the provisions of:

-Law 34/2002 on Information Society Services and Electronic Commerce

-Law 7/1998 on General Contracting Conditions

-Royal Legislative Decree 1/2007, approving the revised text of the General Law for the Protection of Consumers and Users

-Law 3/2014, amending the General Law for the Protection of Consumers and Users

-Law 7/1996 on Retail Trade Regulation

-Royal Decree-Law 14/1999 on Electronic Signature Regulation

Pre-Contractual Information

Users are informed that the steps required to purchase our products will be those shown on-screen at all times and those described in these General Conditions.

The user declares to be aware of and accept these steps as necessary to proceed with the purchase.

The contract between Fauna and the customer will be concluded in either English or Spanish.

Offered Products and Purchasing System

Users can view all products available for purchase in our online store, categorized by sections. Each product is displayed with its price, and users can click on a product to view detailed information such as characteristics, origin, and materials used.

Prices will always be up-to-date, except for possible typographical errors. Fauna reserves the right to determine which products are available for sale, either temporarily or permanently. Fauna also reserves the right to modify prices unilaterally and establish temporary offers.

Billing and Payment Methods

Payments are processed through an SSL-certified secure payment gateway using Shopify Payments. Fauna does not store customer banking details, including credit card information.

To make a purchase, users must be of legal age or, if a minor, have authorization from a legal guardian.

Once a purchase is completed, the customer will receive an email confirmation with order details.

Order Shipping

Fauna commits to delivering purchased goods to the address provided in the billing form. Please note that we only operate within European territory, and deliveries to P.O. boxes or public locations are not available.

Shipping costs are borne by the buyer and will be visible during checkout and order confirmation.

Fauna guarantees the availability of all offered products. However, if a selected product is out of stock, Fauna will contact the user to process a refund if necessary.

Withdrawal and Returns

The buyer has up to fourteen (14) calendar days from the receipt of the product to withdraw from the contract without giving any reason or filing a claim.

Withdrawal rights will not apply, in accordance with Article 103 of Royal Legislative Decree 1/2007, to contracts involving:

-The supply of sealed goods that are not suitable for return due to health or hygiene reasons and have been unsealed after delivery.

For non-exempt products, buyers must notify Fauna of their decision to withdraw via email at info@faunacollect.comor in writing to Fauna's address. Fauna provides a withdrawal form that must be completed and submitted accordingly.

Once the withdrawal is communicated and received by Fauna, an acknowledgment of receipt will be issued. The buyer must return the product without undue delay, and in any case, within 14 days of withdrawal notification. The product must be in perfect condition and in its original packaging. Return shipping costs are borne by the buyer.

Fauna will refund all payments received from the buyer, excluding delivery costs, within 14 days from the withdrawal notification. Fauna reserves the right to withhold the refund until the goods are received or proof of return is provided.
